The service
Gists AI is a product of TakeOnePiece LLC, 1 Broadway, Cambridge, MA 02142. Gists AI sends short surveys to your people in Slack, shows the results to the people you choose, and helps you tell everyone what you are doing about them. Gists AI is in beta: features may change, and we tell you before a change that affects how you use it. The person who accepts these terms confirms they can agree for their company.
Your account
You choose who in your company can set up surveys and see results. You keep sign-in details safe and tell us at support@gists.ai if you think someone has used your account without permission.
How you may use it
Use Gists AI to hear from your people and act on what they say. Do not use it to identify who wrote what, to work around the group size floor, to send anything unlawful, or to try to break or overload the service. How survey results may be used about people is set out in the DPA, which is part of these terms.
Trial
30 days free. No card needed. Nothing is charged until you choose a plan. If you don't choose a plan, everything is deleted 30 days after the trial ends. We email you 7 days before.
Price and payment
The price is on the Pricing page. Only active people count. Someone who leaves stops counting once they're deactivated. Invoice: annual plans. Card: monthly or annual. Invoices are due in 30 days and carry your PO number. 14 days to fix a failed payment before anything stops. Prices do not include taxes, which we add where the law requires.
Cancelling and leaving
- Monthly: cancel any time in Billing. You pay for the month you're in, nothing after.
- Annual: One year at a time. Renews at the same price; we email 60 days before. Turn off renewal in Billing any time before the renewal date. If you cancel mid-year, you keep Gists AI until the year ends; the rest of the year isn't refunded.
If your company cancels, or its trial ends without a plan, its results stay readable for 30 days, and its admins can download all of its data in one file. Then everything it has in Gists AI is deleted: surveys, answers, results, people, teams, settings and connections. We email its admins 7 days before, and again when it's done. Backups clear within two weeks after the deletion. We keep only a record that it happened (the company's id and the date, no names). Invoices stay with Stripe, as tax law requires.
An HR admin can download all of the company's data in one file from Settings: people, teams, privacy settings and their history, and each survey's questions, results, briefs and reports. Results come out as they do in the app: nothing from fewer people than the group size floor, and no one's answers next to their name. The link goes by email to the admin who asked, works for 24 hours, and the file is deleted after 7 days.
Your data
Your company's data stays yours. We use it only to run Gists AI for you, as described in the Privacy Policy and the DPA. Gists AI staff never see who wrote what.
What we promise, and what we don't
We run Gists AI with care and fix problems we find. No uptime commitment (SLA) during beta. Uptime checks and alerts run all day. Beyond that, and as far as the law allows, the service is provided as it is, without other warranties. We are not responsible for Slack, your HR system, or other services you connect.
Limit of liability
As far as the law allows, neither of us is liable for indirect or consequential losses, and each side's total liability under these terms is limited to the amount you paid us in the 12 months before the claim. This does not limit liability that cannot be limited by law.
Changes and ending
We may update these terms. If a change matters, we tell you at least 30 days ahead by email. Either of us may end the agreement by cancelling; we may also end it if these terms are seriously broken and not put right within 30 days of notice.
Law
These terms are governed by the laws of the Commonwealth of Massachusetts, and disputes go to the courts of Massachusetts.
